Types of Workplace Discrimination We Handle
Workplace discrimination takes many forms. We represent Camden County employees in claims involving:
- Pregnancy discrimination
- Disability discrimination
- Racial discrimination
- Religious discrimination
- Sex discrimination and equal pay violations
- Age discrimination
- LGBT discrimination
- Hostile work environment
Discrimination doesn’t always mean an outright firing. It can appear in hiring or promotion decisions, denial of reasonable accommodations, unequal pay for equivalent work, demotions, or adverse schedule changes. In some cases, a facially neutral workplace policy that disproportionately harms a protected group, known as disparate impact, can constitute unlawful discrimination even without discriminatory intent.
Protected Characteristics Under NJLAD & Federal Law
NJLAD is one of the most comprehensive anti-discrimination laws in the country. It prohibits employment discrimination based on race, color, religion, sex, gender identity or expression, sexual orientation, national origin, age, disability, genetic information, pregnancy, familial and marital status, ancestry, liability for military service, and AIDS or HIV status. Critically, NJLAD applies to employers of all sizes, including small businesses that fall below the thresholds of some federal statutes.
Federal protections add additional coverage. Title VII of the Civil Rights Act of 1964 addresses race, color, religion, sex, and national origin. The Americans with Disabilities Act covers disability discrimination. The Age Discrimination in Employment Act protects workers 40 and older. Employers may not discriminate based on actual membership, perceived membership, or association with a member of a protected class.
Why Camden County Workers Choose The Law Firm of Morgan Rooks, P.C.
We represent employees only. That isn’t a marketing line. It means we don’t defend employers against discrimination claims. Every strategy we develop is built from the employee’s perspective.
Our attorneys also bring experience as business owners, which gives us insight into how employer decisions get made and documented. That perspective informs how we identify weaknesses in an employer’s position and build evidence of discriminatory intent or impact. We stay proactive throughout, working to surface complications early and strengthen each claim before they become problems.
We keep clients informed at every stage. You won’t be left wondering what’s happening with your case. Our attorneys have been featured in NBC 10, the Philadelphia Inquirer, Philly Voice, Courier Post, SuperLawyers, PennRecord, Physicians News Digest, Advance Healthcare Network, Medpage Today, and Lancaster Online. Our team includes Franklin J. Rooks Jr., Esq., Clayton W. Morgan, Esq., Vazken A.E. Zerounian, Esq. (Of Counsel), and Sarah May Spletzer, Esq. (Of Counsel).
Filing Deadlines for Camden County Discrimination Claims
Three filing windows apply to New Jersey discrimination claims, and missing any one of them can permanently close off a legal avenue. To file a complaint with the New Jersey Division on Civil Rights (NJ DCR), you have 180 days from the discriminatory act. To file with the Equal Employment Opportunity Commission (EEOC) under federal law, the deadline is 300 days. If you choose to file directly in court, including the Superior Court of New Jersey in Camden County, NJLAD allows two years from the date of the discriminatory act.
Acting quickly matters for reasons beyond deadlines. Early action preserves documentary evidence, keeps potential witnesses accessible, and allows us to advise you on protecting your position while you’re still employed. Filing a complaint while still at your job can also activate legal protections against retaliation.
Damages That May Be Available in a Discrimination Claim
A successful discrimination claim can result in several categories of relief. Compensatory damages may include lost wages and lost benefits. Courts may also award damages for emotional distress, humiliation, and mental suffering. When an employer’s conduct is particularly egregious, punitive damages may be available. Job reinstatement is a possible remedy, and attorney fees may be recoverable in appropriate cases.
Every case is different. The damages available depend on the specific facts, the applicable law, and the circumstances of the claim. We can give you an honest assessment of what relief may apply to your situation during your free consultation.
